Online Gambling Licensing in Brazil: Key Regulatory Updates

The last regulatory pieces fall into place in the lead up to online gambling licensing in Brazil.

Since the beginning of 2024, the Ministry of Finance (Brazil) has been taking several measures to regulate Law No. 14,790/2023 and make licences available. Its Prizes and Betting Secretariat (SPA), among other initiatives, has already issued the following relevant Ordinances:

  • Ordinance No. 300/2024 – regulates the requirements and procedures for accrediting Gaming Laboratories for certifying betting systems, live gaming studios and online games to be used by fixed-odds lottery operators.

  • Ordinance No. 615/2024 – regulates general rules to be observed in payment transactions conducted by operators authorised to operate the fixed-odds lottery in the national territory.

  • Ordinance No. 1233/2024 – provides for the sanctioning regime within the scope of the commercial exploitation of fixed-odds lottery betting.

In accordance with Ordinance No. 827/2024, issued on 22nd May 2024, the licensing process has already started and will remain permanently open. Unlicensed operators will be considered as operating in the black market as from 1st January 2025. Applicants filing within 90 (ninety) days counted as from 22nd May 2024, will have their licences issued (if they do not encounter any incidents or demands for additional information/documentation) by 31st December 2024.
